Preliminary remark

For better readability, the masculine form is used for personal designations and personal nouns in these General Terms and Conditions (“GTC”). In the interests of equal treatment, corresponding terms apply to all genders and gender identifications. The abbreviated language form is for editorial reasons only and does not imply any judgment.

General

FLYFEEL, as a website and logo, is a creation for promotional purposes only; it does not represent to the county the businesses that created it, which alone are responsible and accountable to the law.

Each one of the companies representing FLYFEEL and only this one ( the sole company) as a unique entity is liable to the law for any claim that may arise towards third parties due to its activity.

The companies using the familiar Flyfeel advertising logo are the following:

1) Outdoor tourist activities - Stavros Kostoulas,

2) Frogsports, sports teacher services, Skondras Nikolaos,

3) Sports school services, Savelona Ioanna, responsible: Savelona Panagiotis

4) Freedom paragliding, Sports school services, Vlasopoulos Dionyssis,

5) Freesky paragliding, Training school and equipment rental, Amaxas George,

6) Outdoor activities, Smyris Athanasios,

7) Sports school services, Petratou Ant. Vasiliki.

These companies are responsible for the staff they may employ and for the issue of legal tax documents relating to the customers they serve. No payment is made through the website flyfeel.gr. Customers' payments are accepted by the companies that undertake to carry out the activities at the place of activity.

Tandem flights

General information:

The passenger expressly declares that he is physically and mentally healthy, does not weigh more than 100kg, has no heart or circulatory disorders, balance problems, neurological disorders, or other illnesses, including chronic diseases, and feels able to cope with the strain of the flight. In any case, the activity in these cases takes place at the passenger’s risk. It is the passenger’s responsibility to cancel the flight if:

– no theoretical briefing has taken place.

– he has not understood all or part of the briefing.

– he is under the influence of alcohol, drugs, or medication that impairs his judgment and ability to act.

The passenger accepts the terms and conditions stated on this website by sending the reservation, paying the invoice amount, verbally placing an action order, and/or signing/redeeming gift vouchers. The flight fee does not include the costs for photo and video service, transport to take off, and the like.

The passenger must wear suitable clothing (weatherproof, windproof), sturdy shoes (reaching above the ankles), and tear-resistant gloves. The tandem pilot provides head protection (helmet) and flight equipment. For passengers under the age of 18, the signatures of a parent or guardian are required.

It is the passenger’s responsibility to follow the pilot’s instructions unconditionally and without delay. This is for their safety. In particular, failure to follow the instructions and directions during take-off, flight, and landing may injure the passenger and the pilot. If the pilot’s instructions are not followed, the pilot may exclude the passenger from the flight. In the event of non-compliance, the claim for reimbursement will be rejected. The passenger is liable for personal injury resulting from failure to follow the pilot’s instructions. The passenger is liable for willful or grossly negligent damage to equipment, pilots, or third parties caused by the passenger.


Disclaimer:

The client acknowledges that paragliding involves inherent risks. Participation in tandem flights is at the customer's own risk. Any liability of the tandem pilot (the responsible owners ) or other assistants for damages to participants is expressly excluded. Companies using the Flyfeel logo are not responsible for damage and theft of personal items (valuables) during the flight. Flyfeel is not liable for damages caused by the actions of third parties, other participants, natural disasters, etc., or for delays in the flight program.

Prices and services:

The prices and services offered are based on the current offers on the website www.flyfeel.gr. Prices are per person in euros. Prices are subject to change without notice.

Payment:

It is the passenger’s responsibility to pay by verbal confirmation or booking via the website. When passengers book a flight (by booking on demand or by speaking), the fee is paid at the place of activity.

Paragliding Greece—Fly & Fun will confirm the booking in writing, by phone, or by email. If it has been booked, a gift voucher will be sent to the customer immediately.

It is possible to transfer the chargeable services to another beneficiary.


Agreed dates/weather:  

Paragliding flights are dependent on the weather. For this reason, Flyfeel will contact the passenger between 18:00 and 20:00 the evening before the flight. If the weather is unsuitable for flying, the flight will be postponed.

Expressly points out that even with fixed dates, there is no entitlement to a flight if the weather conditions do not permit it. The flight area is determined by Flyfeel or the tandem pilot, depending on the weather conditions. The pilot decides the details of the flight. The duration of the passenger flight is dependent on the weather conditions.


Cancellation or contract amendment by the customer:

Flight bookings and reservations are binding and can only be canceled up to 48 hours before the scheduled date. If the passenger does not appear or arrives late on the agreed date without notifying the pilot (or Flyfeel) or if the passenger is under the influence of alcohol or drugs, there is no entitlement to a refund, compensation, or reimbursement of any expenses. No money will be refunded if the passenger cancels the activity or leaves early.

Cancellation or contract amendment by Flyfeel.

The pilot is always responsible for making the flight. The pilot has the right to cancel the flight, even at short notice, if they consider that the passenger is unfit due to their behavior, omissions, or other actions that endanger or make fulfilling the contract impossible.

Suppose an activity or parts thereof cannot occur due to force majeure, in particular, due to unsafe weather and physical conditions and related safety concerns on the part of Flyfeel and its pilot(s), as well as official measures, strikes or other reasons. In that case, Flyfeel can cancel or terminate the activity, even at short notice.

Payments made will be refunded. It should be noted that ensuring a risk-free process is in everyone’s interest. The pilot's decisions are final. We expressly reserve the right to change the event, especially venue changes, at short notice. Flyfeel will endeavor to find a suitable alternative.

Passengers act at their own risk.

Paragliding has the risk of an accident cannot be excluded entirely. It is the customer's responsibility to take out accident insurance. The customer is responsible for ensuring that he has adequate health and accident insurance coverage, including for paragliding activities.  Customers do so at their own risk. It is liable only for damages caused by gross negligence or intent. To the extent permitted by law, passengers waive all claims against Paragliding over existing insurance benefits.

If Flyfeel delegates the performance to an affiliated company or a tandem pilot (freelancer), Flyfeel shall not be liable for its acts and omissions. In particular, Flyfeel shall not be liable for damages resulting from acts or omissions of the partner company or the freelance pilot unrelated to the contractually agreed service.

Flyfeel is not liable for damages due to the actions of third parties, other participants, force majeure, natural events, official orders, etc., or due to delayed return home. If the participant does not follow the instructions of the organizer or pilot, etc., all liability of Flyfeel ceases.

Flyfeel liability insurance for tandem paragliding tandem flights covers damages up to 1.500.000,00 million euros.


Data Protection:  

Flyfeel undertakes to electronically process and store customers’ data within the contractual relationship without unauthorized disclosure to third parties. The customer should be aware that, according to the current state of technology, complete data security cannot be guaranteed during transmission via the Internet. At the customer's written request, their data will be destroyed after the end of the service.  

Copyrights:

Flyfeel may use photo, audio, and video material created during the event at any time (e.g., marketing, Facebook, Instagram, TikTok, newsletters, teaching materials, etc.). Customers agree to Flyfeel using these images, videos, etc., commercially, and customers do not claim compensation for this under any circumstances.  Flyfeel reserves all rights to the website https://flyfeel.gr. It is prohibited to download, electronically store, process, and sell the content or any part of the website without the provider’s written consent. Flyfeel accepts no responsibility for the accuracy of the information provided on the https://Flyfeel.gr  website or for typographical errors.

Applicable law and jurisdiction:  

The contractual relationship is subject exclusively to Greek law. The parties agree upon the location of the company’s registered office performing the activity as the exclusive place of jurisdiction—each company representing FLYFEEL reserves the right to bring claims to the customer’s residence. Suppose individual provisions of these General Terms and Conditions are invalid or incomplete. In that case, the invalid or incomplete provision shall be replaced by a legally valid provision that comes as close as possible to the invalid or incomplete provision. This shall not affect the validity of the remaining provisions.  

Participants from the United States or Canada acknowledge that there is no agreement on jurisdiction in the United States or Canada and that Flyfeel does not accept legal processes in those jurisdictions.
